Terms of Service

These Terms of Service ("Terms") govern your access to and use of Mainspring Social, a product of Mainspring Software LLC ("Mainspring Social," "we," "us," or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Using the Service
Mainspring Social lets you plan, create, schedule, and publish content to social accounts you connect. You may use the Service only in compliance with these Terms and all applicable laws, and only in accordance with the terms and policies of any social platform you connect.
Your account
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
Plans, billing, and cancellation
Some features require a paid plan. Prices are shown on our pricing page and are billed in advance, either monthly or annually depending on the plan you choose. Payments are processed by Stripe. We do not see or store your card details.
Paid plans renew automatically at the end of each billing period until you cancel. You can cancel at any time from Account, Plan and billing. When you cancel, your plan stays active for the rest of the period you have already paid for, and then your workspace returns to the Free plan. We do not charge a cancellation fee.
Payments already made are not refunded for time you did not use, with one exception: if you cancel an annual plan within 14 days of the first charge for that year, tell us and we will refund it in full. Beyond that, and for monthly plans, cancelling stops the next payment rather than returning the last one.
If a payment fails, we will keep your plan active while your bank and Stripe retry the charge. If it is still unpaid after those attempts, your workspace returns to the Free plan. Nothing you created is deleted, but limits that apply to the Free plan will apply again.
We may change our prices. If we do, we will tell you before it affects you, and the new price applies from your next renewal, never mid period. If you hold a founding rate, it stays in place for as long as your subscription remains active without a break.
Prices exclude any tax we are required to collect, which is added at checkout where it applies.
Mainspring Sites
Mainspring Sites is an optional add-on under which we build, host, and maintain a website for you. It is not yet available for purchase. These terms govern it from the point it is, and nothing in them obliges either of us before you have agreed to a specific build.
Sites requires an active paid Mainspring Social plan. If that plan lapses or is cancelled, your site stays online through any period already paid for under the care plan, and we will tell you before anything changes.
What you pay
A build is quoted as either a one time build fee followed by a monthly care and hosting plan, or as a single monthly amount with no fee up front. The second route carries a minimum term of twelve months, because that monthly amount is what pays for the build. You may cancel during the term, but the remaining months of that term stay payable. The first route has no minimum term at all.
Costs charged by third parties, including your domain registration after the first year, an email provider, or a booking or payment tool you ask us to connect, are yours and are billed to you directly by that provider. We will tell you what they are before you commit to any of them.
What you own
You own your domain. We register it with you as the registrant, not us, and we will release it to a registrar of your choosing on request, for any reason or none. We will not withhold an authorization code, and we do not treat a domain as leverage in a disagreement about anything else.
One limit on that is not ours to waive. ICANN locks a domain against transfer for 60 days after it is first registered, and again after a change of registrant. Inside that window nobody can move it, us included. We will hand over control of the domain immediately either way, and complete the transfer as soon as the lock lifts.
You own your content. Text, photographs, logos, and anything else you give us remains yours, and you confirm you hold the rights to use it. You also own the finished site: on request, and on the way out, we hand over the source files.
We retain ownership of the underlying template library and the components your site is assembled from, and we may reuse them for other customers. What is yours is your site. What is ours is the toolkit it was built with.
Changes after launch
Every care plan includes two content updates a month. A content update means changing words, prices, hours, photographs, or links on pages that already exist. Unused updates do not carry over. Further updates in the same month are billed at the rate published on our Sites page.
Structural work, which means new pages, new sections, or a change to how the site is laid out, is quoted before it starts and never begun without your agreement to the number.
Timelines
The build times we publish are business days counted from when we have everything we need from you, not from when you place the order. If we are waiting on your content, the clock is paused, and we will say so plainly rather than let a date pass quietly.
Ending it
You may cancel the care plan at any time, subject to any minimum term described above. Your site stays online until the end of the period you have paid for. After that we take it offline, hand over the source files, and transfer the domain wherever you want it. We do not hold a site, a domain, or content hostage against a disputed bill.
We may decline or discontinue a build, in which case we refund any build fee for work not delivered.
Acceptable use
You agree not to use the Service to:
- Violate any law or the rules of a connected social platform.
- Post content that is unlawful, infringing, harmful, or deceptive.
- Send spam or engage in abusive automated behavior.
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
Your content
You retain ownership of the content you create and publish through the Service. You grant us the limited rights needed to store, process, and transmit that content to the social accounts you direct us to publish to. You are solely responsible for your content and for having the rights to use and publish it.
Third-party platforms
The Service integrates with third-party platforms such as Facebook, Instagram, Threads, LinkedIn, Bluesky, Google Business Profile, and Mastodon. Your use of those platforms is governed by their own terms and policies. We are not responsible for the availability, content, or actions of third-party platforms, and a platform may change or limit its access at any time.
Service availability
The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time. We do not warrant that the Service will be uninterrupted, error-free, or that any scheduled post will publish successfully, as delivery depends on third-party platforms.
Limitation of liability
To the fullest extent permitted by law, Mainspring Software LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect means you accept the revised Terms.
